“I had some school loans with Wells Fargo from 2005-2010. Then ACS/NAVIENT bought the loan. Those years were 2011-5/15/2016. Now I receive a letter from Performant Collections stating that they were hired by ECMC to collect money from me because I have defaulted on my loan. They have sent me letters stating they are going to garnish my wages. I filled out paperwork that was sent to me from Performant Recovery, asking for my income and expense. The letter also asked me if I wanted to have a phone hearing. Which I did because I felt that my expenses were more than my income. So, I filled them and sent them. 3 or 4 days later, I received a letter stating that they havent received my paperwork and that they were going to go through with garnishing my wages. So, I called them to see if they got the paperwork. Stacy Fox at Performant Recovery said I qualified for a rehab loan. Stacy made it seem like the only way for them so stop my wage garnishment was loan rehab. She said that for $75 a month for 9 straight months, would then put me in touch with a lender to work out a loan for me. I told her $75 was too much and I couldnt do that. She said that she couldnt do it for anything less. At the time I thought that I cant have my wages garnished so I set up the process of $75 a month for 9 months. Now we went over the process and she that everything looks good and would call me later to finalize it, because there was one more step. Well she didnt call me. When I went home I looked up some info, and then cancelled the payments. I found out that you can pay as little as $5 a month. ECMC bought the loans from ACS/NAVIENT and those dates are 8/25/2016-Present. On my Federal Student Aid website account, it looks like ECMC was the original lender from day one. In the column showing Status Effective Date the last two entries are in repayment date is 10/29/2013. The last line is Defaulted, unresolved date is 8/25/2016. Not until the last month or so do I receive any letter from ECMC stating they are defaulting me. I have never signed any paperwork from ECMC claiming that I have an agreement with them, and I have never signed any promissory note. I am getting calls at work from them about 3 or 4 times a day and, they are calling me on my cell phone while I am working. There are different people calling me.”
